The Saskatchewan Court of King’s Bench has ruled in favor of Timothy Wushke, a former councillor of the R.M. of Rocanville, overturning his disqualification from office.
Wushke was removed in July 2024 over an alleged conflict of interest involving an unauthorized payment for his mother’s benefit. However, Judge S.M. Sinclair ruled on Feb. 4 that Wushke’s removal was procedurally unfair, as he was not informed in advance that his conduct would be discussed, nor given a fair opportunity to defend himself.
The court voided the resolutions that disqualified Wushke and ruled that he was entitled to costs. Other allegations against him, including past conflicts of interest, were left for future court interpretation.
